Responsible for these Terms of Service (“Terms”) is jobdragons.com, email: info@jobdragons.com (referred to as “JobDragons”). These terms are binding for each user (“User”) registering on jobdragons.com.

Please read these Terms and Conditions carefully before using any services offered on the Website.

The Website offers a variety of features and services. A User looking for a job can create a curriculum vitae (“CV”) online and search and apply for job offers solicited by Employers on the Website.

JobDragons may revise these Terms at any time by posting an updated version to this Site. The latest updated version will be applicable to the use of services offered on the Website. Users should visit the Website periodically to review the current Terms. Users can download or print these Terms via their browser. User needs to agree to these Terms in order to use services offered on the Website.

Users who violate these Terms may have their access to and/or use of the Website suspended or terminated at JobDragons sole discretion. JobDragons might remove any content from any Site, which – to JobDragons sole discretion – fails to comply with these Terms.

  1. Use of JobDragons Services

Services offered on the Website should be used by Users seeking employment and/or career information.

 Users agree to:

  1. Required Information about Users (User Account)

For being able to use all services offered by JobDragons on the Website, Users have to register on the Website, create an account (“Account”), and create a curriculum vitae (“CV”).

User allows JobDragons to share User’s data (such as provided in the registration process, saved in User’s Account and CV) with potential employers. JobDragons and potential employers are allowed to contact User with news, updates, and job offers.

a) Registration/Establishing a User Account

The following data will be required to register on the Website:

 After registration, Users can create and update their personal information in a profile, for example with data referring to their gender, birthday, nationality, residence, address details, phone number, preferred language (“Account”). Information submitted by User to create an Account has to be accurate. 

b) Creating a CV

User’s data will be presented as CV on the Website and accessible for JobDragons and potential employers. The profile consists of fields User has to fill in with respective information, such as work experience education, languages etc.). If selecting option for “only JobDragons to see” the CV will not be accessible by Employers  

c) Termination of Accounts

Users themselves or JobDragons may initiate a process of terminating an Account. In that case all information in connection to respective Account will be marked as deleted and may be deleted from JobDragons databases. User acknowledges and agrees that in case respective Account is terminated, all information relating to respective User, including User’s CV, Account, cover letter, saved job posts, etc. will be deleted and will be removed from any public area of the Website. Information may continue to be available for some period of time due to delays in propagating such deletion through JobDragons web servers. In addition, third parties may retain saved copies of User’s information. JobDragons reserves the right to delete an Account and all relating information after a significant duration of inactivity. Users will not have access to deleted information. Because of delays in processing a termination of Accounts, information may be available on User’s account for some time after the termination had been initiated before being deleted.

  1. Website Content

All Website content (including but not limited to audio files, codes, data, designs, graphics, icons, images, information, logos, messages, music, pictures, software, sounds, texts, videos) is protected under intellectual property law and other laws. It is not permitted to use any Website content outside the Website for commercial purposes not impliedly or expressly authorized by JobDragons. Nothing in these Terms shall be construed as granting any license for intellectual property rights to User. Unauthorized use of any Website content may violate applicable laws and will be prosecuted by JobDragons

  1. Content created by Users

User will create content (possibly including but not limited to audio files, data, designs, emails, graphics, images, information, logos, messages, music, pictures, texts, trademarks, videos) by way of posting, publishing, and/or sending (or submitting in any other way) in connection with the Website or any communication with JobDragons (“User Content”). 

By creating User Content, User agrees to grant and transfer to JobDragons, its legal representatives, assignees, and those acting in its authority, the unrestricted, irrevocable rights and permission to adapt, distribute, publish, reproduce, and/or sublicense such User Content for internal use, advertising or any other lawful purpose. User will not claim any rights in connection with User Content and/or claim for remuneration against JobDragons or third parties. User waives any right that User may have to examine or approve User Content and products thereof used for any kind of publication. Users acknowledge and agree that other users and/or employers access, display, view, store and reproduce User Content. 

 JobDragons expressly reserves the right to accept, alter, display, post, refuse, reproduce, and/or transmit any User Content in JobDragons sole discretion. 

 Any User Content submitted to the Website may not contain information that includes or may be interpreted to include a direct advertisement, recruitment offer, or solicitation for an open job position directed to other users. 

  1. JobDragons Liability

JobDragons makes no representations about any content created by JobDragons, Employers, and other Users on the Website (including but not limited to such content’s accuracy, completeness, reliability, and/or how up-to-date such content is).

 To the fullest extent possible JobDragons will not be liable for any loss, arising out of or in connection with the use of the Website and any kind of indirect, special, incidental, reliance or consequential damages (including lost profits), regardless of the form of action the claim against JobDragons. Furthermore, JobDragons entire liability is limited to $ 500. 

  1. Indemnification

User will defend, indemnify, and hold harmless JobDragons, its connected companies, and their respective managing directors, employees, and agents, against any claims, actions or demands, including reasonable legal fees against JobDragons arising as a result or in connection with any User Content and/or other data User provides to any Site.

  1. Links to Homepages managed by Third Parties

The Website contains links to homepages managed by third parties. JobDragons is not responsible for content of such homepages and does not make any representations regarding contents. User visits linked third-party homepages on its own risk.

  1. Choice of Law

These Terms are governed by the laws of the Kingdom of Cambodia.

  1. Severability 

If any provision of these Terms are invalid or contain gaps, this does not affect the validity of the remaining provisions. Such invalid provision shall be replaced and the gap shall be filled by a valid provision which corresponds to the meaning and purpose of the invalid provision and which corresponds to what would reasonably have been agreed by the Parties in accordance with the sense TERMS OF SERVICE (for Employers). 

Terms for Employers and Training Providers

Please read these Terms carefully before using any services offered on the Website.

JobDragons offers Employers and Training Providers an online platform to publish job postings and training courses to job seekers on the Website (“Users”) or job seekers and companies visiting the Website (“Visitors”). A User can create a curriculum vitae (“CV”) online and search and apply for job offers solicited by Employers on the Website. Employers can post jobs online and search CVs posted by Users. Training companies can post training course details that can be viewed by Users and Visitors.

JobDragons recommends printing these Terms for future use. Employers can download or print these Terms via their browser. An up-to-date version of these Terms is available on the Website. Employer needs to agree to these Terms in order to use services offered on the Website.

JobDragons may revise these Terms at any time by posting an updated version on the Website. The latest updated version will apply to Employer’s use of services offered on the Website. Employers should visit the Website periodically to review the current Terms.

Employers who violate these Terms may have their access to and/or use of the Website suspended or terminated at JobDragons sole discretion. JobDragons might remove any content from any Site, which – to JobDragons sole discretion – fails to comply with these Terms. 

  1. JobDragons Services (Permitted Use, Offered Services/Prices/Terms, Commencement, Payment/Invoice, End of Term) 

a) Permitted Use

Services offered on the Website should be used by Employers seeking potential employees.

Service packages offered on the Website may include a trial package (“Trial Services”) as well as paid packages (”Paid Services”). Information about content, pricing and terms of packages is available on the Website.

Services can include sharing data with Employer that is derived from content created by Users. JobDragons does not make any representations regarding the accuracy or validity of such data or its appropriateness for evaluation by Employer. Employers acknowledge that any reliance on material posted by Users will be at Employer’s own risk.

c) Commencement of Services

JobDragons confirms booking of Trial Services and Paid Services by a booking confirmation mail (“Booking Confirmation”) that constitutes the date of the commencement of respective services.

In case a registered Employer uses Trial Services, such use starts after booking Trial Services and receiving a Booking Confirmation for Trial Services.

In case a registered Employer or Training Provider uses any Paid Services or Membership, the Employer or Training Provider has 7 days to pay the invoice or services will be suspended and my result in information deleted from the website. This process is at the discretion of JobDragons

d) Payment and Invoice

For payment, Employer can choose from the payment methods offered on confirmation of membership.

In case of payment via money collection, Employer/Training Provider will receive an invoice upon payment.

In case of online payment, Employer/Training Provider will receive an invoice by email, hereby agreeing to receiving invoices in electronic form.

e) End of Term

Trial Services and Paid Services end upon expiry of respective term of booked services.

Furthermore, JobDragons reserves the right to terminate any Trial Services or Paid Services in case Employer violates these Terms.

  1. Required Information about Employers / Training Provider Account

For being able to use all Trial Services or Paid Services offered by JobDragons on the Website, Employers have to register on the Website and create an account (“Employer Account”).

a) Registration/Establishing an Employer/ Training Provider Account

Employer / Training Provider or JobDragons may initiate the process of terminating an Employer Account. In that case all information saved in connection to respective Employer Account will be marked for deletion and may be deleted from JobDragons databases within a short time. Employers will not have access to deleted information.

Employer acknowledges and agrees that in case an Employer Account is terminated; all information saved in the Employer Account will be deleted and removed from any public area of the Website. Information may continue to be available for some period of time because of delays in propagating such deletion through JobDragons web servers. In addition, third parties may retain saved information relating to Employer. JobDragons reserves the right to delete an Employer Account and all relating information after a significant duration of inactivity, except if Paid Services are booked with respective Employer Account.

JobDragons Cambodia reserves the right to delete an Employer Account and all relating information after a significant duration of inactivity, except if Paid Services are booked with respective Employer Account.

  1. Job Posts

Employers can create a Site by publishing data accessible to Users and Visitors to solicit and offer a job position (“Job Post”).

Employer agrees to deal reasonably and professionally with Users who respond to any Job Post. JobDragons does not guarantee that Users responding to Job Posts are suitable for the offered job position. Employer acknowledges that it might be necessary to perform checks and implement procedures to the extent necessary at Employers own discretion to ensure Users are suitable and qualified for the offered job position.

If a Job Post or communication with regard to a Job Post conflicts with any requirements set out in these Terms or if the conformity of any Employer Content (as defined below) with these Terms is in doubt, JobDragons may in its own discretion take appropriate measures to enforce conformity of any conduct with these Terms (not publishing respective content is to be considered an appropriate measure in such circumstances).

Employer expressly grants JobDragons the right to use Employer’s company name and respective trademarks for the purpose of increasing visibility and number of applications through booking advertising and/or search optimization in connection with search engine marketing.

  1. CV Database

JobDragons manages, saves, and processes various CVs submitted by Users in a CV Database (“CV Database”).

a) Use of the CV Database

Employer has to ensure that its use of the CV Database and all connected data is in accordance with all applicable privacy and data protection laws. Employer agrees not to share any of the data from JobDragons CV Database with any third party, unless authorized in writing by JobDragons Cambodia.

Employers are obliged to take appropriate measures to protect data received from JobDragons CV Database from access by third parties. It is prohibited to use CV Database’s data in any kind of automatic process that involves scanning, downloading or evaluating the CV Database; including scraping.

Data from JobDragons CV Database must not be used:

Employer agrees to deal reasonably and professionally with Users contacted in connection with the CV Database. JobDragons does not guarantee that Users listed in the CV Database are suitable for offered job positions. Employer acknowledges that it might be necessary to perform checks and implement procedures to the extent necessary at Employers own discretion to ensure Users are suitable and qualified for the offered job position.

b) Rights relating to CV Database

All intellectual property and other rights relating to CV Database belong to JobDragons. Employer acknowledges and agrees that Employer does not acquire any rights relating to the CV Database except as necessary and to the extent for JobDragons to perform offered services.#

  1. Content created by Employers and Training Providers

Employers and Training Providers are solely responsible for their postings on JobDragons.

Employers and Training Providers will create content (possibly including but not limited to audio files, data, designs, emails, graphics, images, information, logos, messages, music, pictures, texts, trademarks, videos) by way of posting, publishing, and/or sending (or submitting in any other way) in connection with the Website or any communication with JobDragons or Users (“Employer Content”).

By creating Employer/Training Provider Content, Employer allows JobDragons to publish content for the purpose of providing the offered services. Offered services may include publications of Employer Content by third party service providers.

Employer/Training Providers further allows JobDragons to mention the company (and related content) as reference customer in JobDragons marketing materials; this involves presenting examples of the services provided to Employer.

Employer acknowledges and agrees that certain Users and Visitors might access, download, store and/or reproduce Employer Content in their own discretion beyond JobDragons control.

JobDragons expressly reserves the right to refuse to accept displaying and/or publishing any Employer Content in JobDragons sole discretion.

  1. Fair Use Policy (unlimited posting of jobs and training programs)

The JobDragons “Unlimited” posting is designed to offer employers and training providers a large number of postings to meet the needs of their business. To ensure that all JobDragons Employer and Training Provider members can continue to benefit from this high value posting service, JobDragons reserves the right to restrict or cancel the access for any Employer/Training Provider that is deemed to have excessive use that negatively impacts the user experience for job seekers, training seekers, or other Employers/Training Providers. The option of either warning emails or instant cancellation of services for excessive use is entirely at the discretion of JobDragons.
